1. Acceptance of Terms

Please read these Terms and Conditions (“Terms”) carefully before using the ShapeShift mobile application (the “App”) operated by Ainigames (“us,” “we,” or “our”). Your access to and use of the App is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you must not access the App.

2. Intellectual Property Rights and Content

The App provides users with access to printable paper models (“Assets”) for personal, recreational use. You acknowledge and agree to the following:

• a) Third-Party Assets: The majority of Assets available in the App, including but not limited to models of mainstream cartoons, vehicles, and game characters, are NOT the property of ShapeShift or Ainigames. All copyrights, trademarks, and intellectual property rights for these Assets are retained by their respective copyright holders. ShapeShift is NOT a licensed distributor of this content, does not claim ownership, and their availability in the App does not constitute a sale or transfer of any rights.
• b) Premium Assets: The App may feature a “Premium Section” containing Assets that are the original creation and exclusive property of Ainigames. These Assets are protected by copyright and other intellectual property laws.

3. Disclaimer of Warranties

THE APP AND ALL ASSETS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AINIGAMES DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, NOR DO WE MAKE ANY WARRANTY AS TO THE ACCURACY, LEGALITY, OR QUALITY OF THE THIRD-PARTY ASSETS.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AINIGAMES, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE APP; (B) ANY ASSETS OBTAINED FROM THE APP; (C) ANY ALLEGED OR ACTUAL COPYRIGHT INFRINGEMENT OR OTHER INTELLECTUAL PROPERTY CLAIMS RELATED TO YOUR USE OF THE ASSETS.

YOU, THE USER, AGREE THAT YOU DOWNLOAD AND USE ALL ASSETS ENTIRELY AT YOUR OWN RISK.

5. Indemnification

You agree to defend, indemnify, and hold harmless Ainigames and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of: a) your use and access of the App and its Assets; b) a breach of these Terms; or c) your violation of any law or the rights of a third party, including without limitation any copyright, property, or privacy right.

6. User Conduct

By using the App, you agree not to use the App or its content for any commercial purpose or in any manner inconsistent with any and all applicable laws and regulations.

7. Termination

We may terminate or suspend your access to our App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms and Conditions within the App.

Account Termination:

Kindly follow the Following Procedure to Delete the account associated with ShapeShift.

• Email us at “info@enigma4d.com”. specifying the subject as account deletion.
• Kindly include the user id (email address used to make the account in ShapeShift).
• Our representative will be in touch within 2-3 working days.

Upon receiving the email and confirmation. all of your data* will be deleted immediately.

* User id, account, password, profile pictures, saved navigation and travel history.
